Terms and Conditions
Redemption
Gift Certificates must be redeemed toward the purchase of eligible products or services at the Torrey Pines Gliderport, located at 2800 Torrey Pines Scenic Drive, La Jolla, CA 92037 (“Gliderport”). Redemption of Gift Certificates for eligible products and services is subject to change at the Gliderport’s sole discretion. Gift Certificates must be used in full at time of purchase. Any remaining balance at the time of redemption will be forfeited if not used. If an order exceeds the amount of the Gift Certificate, the balance must be paid with cash or credit card. The Gliderport may provide Gift Certificate purchasers with information about the redemption status of Gift Certificates that they purchase. Gift Certificates may not be used in combination with other offers.
Limitations
Gift Certificates are not refundable. Gift certificates never expire! If you are NOT able to use it on what it was originally purchased for (EX. Tandem Flight), you can transfer the gift certificate to another person or use the credit towards something else in the office. Gift Certificates cannot be reloaded, redeemed for cash or applied to any other account, except to the extent required by law.
Risk of Loss
The risk of loss and title for Gift Certificates pass to the purchaser upon our electronic transmission to the purchaser, recipient or delivery to the carrier, whichever is applicable. We are not responsible if a Gift Certificates is lost, stolen, destroyed or used without your permission.
Fraud
The Gliderport will have the right to close customer accounts and bill alternative forms of payment or terminate the eligibility of a Gift Certificate if a fraudulently obtained Gift Certificate is redeemed and/or used to make purchases.
Limitation of Liability
THE GLIDERPORT AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CERTIFICATES, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CERTIFICATE CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY SHALL BE THE REPLACEMENT OF SUCH GIFT CERTIFICATE. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
Disputes
Any dispute relating in any way to Gift Certificates in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $7,500 shall be adjudicated in state or federal court in San Diego, California, and you consent to exclusive jurisdiction and venue in such courts.
General Terms
Torrey Pines Gliderport Gift Certificates are issued by Air California Adventure, Inc., a California corporation. When you purchase, receive or redeem a Gliderport Gift Certificate, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these Gift Certificate terms and conditions. The Gliderport reserves the right to change these terms and conditions from time to time in its discretion. All terms and conditions are applicable to the extent permitted by law.
